Practice Directions 2022

Practice Direction 5 of 2022

This Practice Direction is issued pursuant to section 592 of the Children, Youth and Families Act 2005 (the Act).

1. This Practice Direction applies to Family Division proceedings in the Children’s Court of Victoria.
2. This Practice Direction suspends the operation of the paragraphs (indicated below) of Practice Direction No. 2 of 2022 dated 2 March 2022, and paragraphs 11, 12 and 13 of Practice Direction No. 3 of 2022 dated 2 March 2022.      
3. The suspension has effect from 13 August 2022 to 2 September 2022 (inclusive).

Practice Direction 4 of 2022

Practice Direction No. 4 of 2022 suspends certain paragraphs of Practice Directions 2 and 3 of 2022, for the period 14 July 2022 to 12 August 2022.

Practice Direction 3 of 2022

This Practice Direction is issued pursuant to Section 592 of the Children, Youth and Families Act 2005 (the Act).

1. This Practice Direction applies to all intervention order applications made pursuant to the Family Violence Protection Act 2008 and the Personal Safety Intervention Orders Act 2010, with effect from 21 March 2022.       
2. Practice Directions No. 3 of 2021 and No. 15 of 2021 are revoked.

Practice Direction 2 of 2022

This Practice Direction is issued pursuant to section 592 of the Children, Youth and Families Act 2005 (the Act). It replaces Practice Direction No. 2 of 2022 dated 2 March 2022 and applies with effect from 5 September 2022 to the following proceedings in the Family Division:

• child protection proceedings; and
• proceedings under the Terrorism (Community Protection) Act 2003.

Practice Direction 1 of 2022 (revoked)

This Practice Direction is issued pursuant to Section 592 of the Children, Youth and Families Act 2005 (the Act).

1. This Practice Direction applies to all Criminal Division proceedings filed with the Children’s Court of Victoria (the Court), other than CAYPINS matters, with effect from 21 March 2022. 
2. Practice Directions No. 2 of 2021 and No. 15 of 2021 are revoked.
3. Paragraphs 6-45 are Directions that apply to all venues, state-wide, of the Court. 
4. Paragraphs 46-50 are Directions that apply to the Court sitting at Melbourne.
5. Paragraphs 51-54 are Directions that apply to first remand hearings where the proper venue is either the Court sitting at Moorabbin or Sunshine.
