The President of the Children’s Court of Victoria has issued Practice Direction 2 of 2024, in relation to the management of criminal and intervention order proceedings at Melbourne and metropolitan courts. These changes ensure that children and young people are not detained in adult custody cells, will not have their cases determined in adult Courts and will not have to travel to multiple court venues. These changes will improve timeliness, and support and accountability for children and young people before the Court.
This Practice Direction is issued pursuant to section 592 of the Children, Youth and Families Act 2005 (the Act). It revokes and replaces Practice Direction No. 3 of 2023 dated 20 October 2023 and applies with effect from 18 April 2024 to the following proceedings in the Family Division:
child protection proceedings; and
proceedings under the Terrorism (Community Protection) Act 2003.
