This chapter commences with a discussion of the jurisdiction of the Children’s Court to make intervention orders under the Family Violence Protection Act 2008 [FVPA] and the Personal Safety Intervention Orders Act 2010 [PSIA], including the relationship between these two Acts and between each of them and various other Acts. Procedure under both Acts is discussed, including service and substituted service provisions and the representation of children.
The chapter continues with a detailed discussion of interim & final intervention orders under both the FVPA and the PSIA, including conditions which may be placed on such orders and provisions relating to the variation, revocation and extension of such orders. The chapter concludes with general provisions relating to costs, re-hearings and appeals together with a discussion of enforcement powers and contravention proceedings.
