Chapter 8: Criminal - Investigation

law books

Much of the material in this chapter is also relevant to other Victorian courts.

This chapter lists a large number of statutory provisions which empower a judge or magistrate to issue a warrant to search premises (and/or sometimes a person) for particular items. It continues with a very detailed discussion of the provisions of the Crimes Act 1958 which regulate the conduct of records of interview and the elaborate case law which has developed in relation to the admissibility of such records of interview.

The chapter continues with a discussion of provisions in the Crimes Act 1958 relating to the fingerprinting of children and adults and concludes with the provisions relating to the application for and the making of an order for a forensic procedure or a compulsory procedure.
